TERMS OF USE

https://c.ingeniat.com/ (hereinafter, the Web) is a website owned by Geniat, SA de CV (hereinafter, GENIAT), Mexican company domiciled at Av. Pablo Neruda 4341 Local D10 y D11 Villa Universitaria CP 45110, Zapopan, Jalisco México.

Access, reproduction and use of the Web services requires prior acceptance of the Conditions of Use in force at all times; GENIAT reserves the right to modify these Conditions when it deems it appropriate, by publishing the new text on the Web. It is the user's responsibility to know the Conditions of Use before accessing the products and services on the Web; if you are not satisfied with them, please refrain from using it.

PROPERTY
The Web is a work composed of various integrated and inseparable elements (text, illustrations, photographs, sounds, music, animated images, videos, computer programs, including the html codes of the website, etc.), whose Intellectual Property corresponds to GENIAT, except in relation to those materials obtained under license from third parties.


GENIAT and its licensors retain at all times the Intellectual Property on the Web and on the different elements that compose it, individually considered, in all the copies that are made (whatever the support to which they are incorporated), granting only the rights of use described below. Any right that is not expressly assigned is understood to be reserved.


GENIAT is also the sole owner of the design and graphic image of the Web, reserving the actions that legally correspond to it against people who could make imitations or unfair uses of it.


The Trademarks of GENIAT or third parties that appear on the Web may not be reproduced or used separately, outside of the places on the Web where they appear.



REGISTRATION AND DATA PROTECTION
Some sections of the Web are freely accessible but, in others cases (Parents, Teachers and Newsletter), it is an essential requirement to access and benefit from its advantages that you register through the form provided for this purpose, under the conditions outlined in the Privacy clause.


The Students section will be free navigation in any case, without GENIAT collecting any personal data from them.

WEB CONTENTS AND DOWNLOADS. PERMITTED USES
It is allowed:


•       Browsing the Web, that is, accessing and viewing it on a device, with any temporary or accessory reproduction being authorized, provided that it is not voluntary and forms an integral and essential part of the technological transmission process. Navigation through certain sections of the Web requires prior registration.

  Permanently reproduce on any type of computer medium (except network server centers or equivalent devices) the materials expressly indicated on the Web as susceptible to free download, under the conditions below They are indicated in this same clause.


•       Prior registration, benefit from the services and advantages provided by GENIAT through the Web to its registered users, under the conditions expressly indicated in the different sections.
The authorized operations may be carried out in the private sphere, and the copies legitimately obtained both of the contents of the Web and of the products indicated therein as susceptible to download, may only be used for strictly personal and private purposes of users.


Any operations regarding the Web, its contents, downloaded products and copies of all of them that are contrary to the Law, good customs and good faith and, especially :


•       Any use outside the personal and private sphere, especially those for commercial or professional purposes, including the sending of advertising or messages and the collection and processing of data from third parties.


•       Its modification and, in general, any transformation thereof, including the translation, adaptation, arrangement, or any other, including the correction of errors in computer programs, from which successive versions or derivative programs cannot be made either. .


•       Its loading and / or use in any computer network system, although access to it cannot be made simultaneously by the different users of said network.


•       Any type of extraction, public communication and / or transmission, total or partial, by any means, outside the private sphere of permitted use and, especially, its incorporation into any other work, including web pages, collections or databases. The publication in the media of downloadable materials from the Press Room section is exempt from this prohibition.


•       The removal, concealment or falsification of the notices and warnings about the Intellectual or Industrial Property of the Web or of any of the products provided through it.


•       The operations and activities expressly prohibited in any other sections of these General Conditions and, in general, any that may harm the normal functioning of the Web, GENIAT, other users or any third party.

LINKS TO THE WEB
The establishment of links and hyperlinks with the Web from other pages or web sites is authorized , as long as they are not done in a way that damages the public and brand image of GENIAT, the Web or any of the people and products referred to in it. In the establishment of links with the Web, the use of techniques that imply confusion about the identity and ownership of the contents, such as framing or others, is expressly prohibited.


The establishment of links from pages or web sites whose contents promote or apologize, directly or indirectly, of any type of violence, discrimination, pornography or illegal activity is prohibited. Likewise, the establishment of links for commercial purposes is expressly prohibited.


In the creation of the links, the use of elements extracted from the Web is expressly prohibited, without the prior and express consent of GENIAT.


In no case can it be understood that links to the Web from third party pages or websites imply relationships between GENIAT and their owners, nor does it imply endorsement, sponsorship or any recommendation of GENIAT about them, so GENIAT will not be responsible in any way regarding their content and legality.
 
CONTENTS AND USER BEHAVIOR
As a client or user of the Web you agree to make appropriate use of the contents and services (as per For example, downloading materials, possible chat services, discussion forums or newsgroups) offered through it, and not using them to (i) engage in illicit, illegal or contrary to good faith and public order activities; (ii) disseminate content or propaganda of a racist, xenophobic, pornographic nature, of apology for terrorism or an attack against human rights; (iii) cause damage to the physical and logical systems of GENIAT, its suppliers or third parties, introduce or spread computer viruses or any other physical or logical systems that are capable of causing the aforementioned damage; (iv) disseminate content that threatens the image and reputation of GENIAT or third parties (v) violates the rights of Intellectual Property, Industrial, image, honor or others that correspond to GENIAT or third parties.  


GENIAT will have full freedom to decide whether the contributions and messages are finally published on the Web or not, being empowered to withdraw them when it deems appropriate. GENIAT is empowered to publish on the Web the contents provided by you in a partial, summarized or abbreviated way.


By simply sending a work, collaboration or comment, you empower GENIAT, in addition to including it on the Web, to, by itself or by transferring it to third parties, to proceed with its reproduction, distribution and public communication, in a complete, condensed, adapted or abbreviated version, free or onerous, worldwide, in all languages, and in other products that you make. The assigned rights may be exercised in printed format, in any publishing modality, in electronic support (optical, magnetic, magnetic-optical or digital) and by any means of transmission and / or distribution.


The inclusion on the Web of elements provided by users does not imply endorsement, sponsorship or recommendation of GENIAT on them, so we will not be in any way responsible for their content and legality.


The infringement of any of the rules contained in these Conditions of use and, especially, of the provisions of this clause, will empower GENIAT to immediately unsubscribe you as a user or subscriber of the Web.

THIRD PARTY CONTENT
The inclusion in the Web of elements provided by third parties (other than users) does not imply endorsement, sponsorship or recommendation of GENIAT on them, so GENIAT will not be responsible at all regarding their content and legality.


By providing through the Web access (through links or banners) to pages and websites, information, services, programs or data belonging to third parties, GENIAT is not becomes the editor of said content, nor is it responsible, directly or indirectly, for any claims that may arise from the quality, reliability, accuracy, legality or correction thereof.

MODIFICATIONS
GENIAT reserves the right to make, without prior notice, the modifications it deems appropriate on the Web, being able to change, delete or add both the content and services provided through it, as well as the way in which they are presented or located.  


Although GENIAT will use its best efforts to keep the information on the Web updated and error-free, it does not offer any guarantee regarding its accuracy and updating. Neither is the obtaining of any specific result or purpose guaranteed, so access to and use of the Web is the sole responsibility of users and clients.


Except where expressly stated otherwise, transmissions from the Web are not made in a secure environment. Consequently, GENIAT does not guarantee that access will be uninterrupted or free of errors, being exonerated from any responsibility for damages derived from the use or impossibility of use (including all indirect damages, among others, loss of profits, business opportunities, of information, etc.).

LEGAL ACTIONS
GENIAT will pursue the breach of These Conditions of Use, as well as any improper use of the Web or its contents, the infringements of the rights that correspond to it or its licensors, especially those of Intellectual and Industrial Property, exercising all actions, civil and criminal, that may correspond in Law.
